Terms of Service

Overview
These Terms of Service govern your use of Seismograph, a monitoring platform operated by Seismograph AI ("Seismograph," "we," "us"). By using Seismograph's services, you agree to these terms.
Please read these terms carefully. If you do not agree, do not use the service.
1. The Service
Seismograph provides:
- ✓Continuous monitoring of your declared infrastructure endpoints
- ✓AI-powered incident diagnosis and dependency correlation
- ✓Alert delivery via email and optional connected channels, including Slack
- ✓Deploy correlation via GitHub webhook integration
- ✓Hourly health snapshots and reporting
Seismograph operates the monitoring infrastructure used to provide the service.
2. Your Responsibilities
What You Provide
You are responsible for:
- ✓Providing accurate endpoint URLs and configuration during onboarding
- ✓Declaring the SaaS dependencies your endpoints rely on
- ✓Connecting and maintaining optional notification integrations you choose to use, including Slack through OAuth
- ✓Configuring GitHub webhooks correctly if using deploy correlation
- ✓Keeping your contact information current
Acceptable Use
You may use Seismograph only to monitor infrastructure that you own or have explicit authorization to monitor. You may not use Seismograph to:
- •Monitor endpoints belonging to third parties without their authorization
- •Attempt to probe, scan, or stress-test third-party infrastructure
- •Circumvent access controls on any system
- •Use the service for any unlawful purpose
Your Endpoints
You represent that you have the right to monitor all endpoints you declare to Seismograph. Seismograph makes HTTP requests to your declared endpoints as part of normal monitoring operations. Ensure your infrastructure permits these requests.
3. Data and Confidentiality
Your Data
As between you and Seismograph, you retain all rights in the endpoint configurations and other data you provide. Seismograph may process monitoring results and derived data as described in these Terms and the Privacy Policy.
Cross-Client Aggregation
Seismograph uses anonymized signal data across clients to improve vendor incident detection. This aggregation uses only degradation counts and timestamps — never your endpoint URLs, client identity, or any identifying information. See our Privacy Policy for details.
Confidentiality
Seismograph treats your infrastructure configuration and monitoring data as confidential. We do not share client-specific information with other clients or third parties except as required to operate the service, as described in our Privacy Policy.
4. Service Level and Availability
Monitoring Cadence
- ✓Endpoint probes: every 60 seconds
- ✓Hourly health snapshots: best effort, within 5 minutes of the scheduled hour
- ✓Alert delivery: within 2 minutes of detection under normal conditions
Availability
Seismograph operates on a best-effort basis. We do not guarantee 100% uptime of the monitoring platform. In the event of Seismograph platform downtime, monitoring will resume automatically when the platform recovers.
No Guarantee of Detection
Seismograph is designed to detect infrastructure incidents quickly and accurately, but does not guarantee detection of every incident. Monitoring effectiveness depends on accurate dependency declaration, correct endpoint configuration, and the availability of third-party data sources.
5. Pricing and Payment
Seismograph offers published plans priced by the number of endpoints monitored. Custom pricing or terms may apply to Enterprise customers.
Current self-service plan pricing and billing options are published on the Pricing page. If you enter into an Enterprise service agreement, that agreement governs its applicable commercial terms.
6. Trials
The self-service trial is provided at no cost for 30 days. During a trial:
- ✓Available features are determined by the applicable trial plan
- ✓Data collected during the trial is subject to our Privacy Policy.
- ✓You may end the trial at any time
- ✓Trial data is deleted within 30 days of trial end unless you convert to a paid engagement
7. Intellectual Property
Seismograph IP
The Seismograph platform, including its software, proprietary algorithms, workflows, configurations, user interfaces, and documentation, is owned by Seismograph or its licensors. These terms do not grant you any rights to the platform itself — only the right to use the service as described.
Your IP
The parties' respective rights concerning customer-provided data, monitoring results, and derived data are described in the Your Data section above and in the Privacy Policy.
8. Limitations of Liability
To the maximum extent permitted by applicable law:
- ✓Seismograph is not liable for any damages arising from failure to detect an incident
- ✓Seismograph is not liable for any damages arising from false positive alerts
- ✓Seismograph is not liable for any indirect, incidental, consequential, or punitive damages
- ✓Seismograph's total liability for any claim arising under these terms is limited to the fees paid by you in the 3 months preceding the claim
Seismograph is a monitoring and diagnostic tool. It is not a substitute for your own infrastructure redundancy, business continuity planning, or disaster recovery procedures.
9. Indemnification
You agree to indemnify and hold harmless Seismograph AI and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from:
- ✓Your use of the service in violation of these terms
- ✓Your monitoring of endpoints you do not have authorization to monitor
- ✓Your breach of any representation made in these terms
10. Termination
By You
You may terminate your service with Seismograph at any time by contacting support@seismograph.ai. Access to the platform will be maintained through the end of your current billing period.
By Seismograph
Seismograph may terminate or suspend your access if:
- ✓You violate these terms
- ✓You fail to pay amounts owed for the service
- ✓Seismograph determines in good faith that continued service poses a legal or security risk
Upon termination, your data will be deleted per the retention schedule in the Privacy Policy.
11. Modifications to These Terms
We may update these terms from time to time. For material changes, we will notify you via email at least 14 days before changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.
The current version of these terms is always available at seismograph.ai/terms.
12. Governing Law
These terms are governed by the laws of the State of Virginia, United States, without regard to conflict of law principles. Any disputes arising under these terms will be resolved in the courts of Virginia.
13. Entire Agreement
These terms, together with the Privacy Policy and any applicable Enterprise service agreement, constitute the entire agreement between you and Seismograph regarding use of the service. They supersede any prior agreements or understandings.
